WORKERS WITH SPECIAL EMPLOYMENT
legal basis: Articles 60-77, guideline CIRCULAR -SDG-461-2007, from 12 March of 2007
1. Workers with a special employment must be employed in their homeland.

2. If the foreigner is staying illegally in the country, it is not possible to request a residence permit under the category "workers with special employment".

3. In order to request a residence permit under the category "workers with special employment", the employees must present a request, authenticated by an official notary. The request should contain the following documents:

a) Background of the request, in which the reasons of the request and the activities, which the foreigner will perform in the country, are explained.

b) Data of the applicant:

" Complete name
" Nationality
" Occupation
" Address and telephone number in Costa Rica
" Place within the legal district of San José or an electronic medium determined by the Ministry, which is specified in the Official Journal, in order to receive notifications.
" Date and signature

c) Data of the foreign worker:

" Complete name
" Nationality
" Date of birth
" Address of the job
" Accommodation; if an accommodation is made available, this must be in accordance with labor laws.
" Indication of the prospective duration of stay in Costa Rica

4. Proof of sufficient financial means, so that the salary of the worker, who is to
receive a residence permit, is ensured.

5. Authenticated copy of the passport of the worker. If the foreigner did enter without passport or does not possess a passport when the request is submitted, a residence permit in this special category cannot be issued.

6. Copy of the identity card, authenticated by an official notary.

7. Birth certificate specifying the names of the parents

8. Certificate of good conduct from which it follows that the applicant did not commit any crime in his homeland as specified in article 63.

a. In order to be valid for receiving a temporary residence permit, the birth certificate, certificates on previous convictions, copies of the passports or other documents which were issued abroad must be present as certified translations in Spanish or certified by a notary with appropriate knowledge of the relevant language. The birth certificate must be issued in the homeland. If previous convictions are present, the certificates must have been issued in the homeland or the country, in which the foreigner has been living legally during the past three years. The legality of this stay must be explained reliably.

b. In exceptional cases, when it is impossible to submit the birth certificate with the names of parents and/or the certificates on previous convictions because the government in the homeland can not issue them or because of other serious reasons, one can be excempted from submitting these documents by placing a request to the Ministry, in which the impossibility
must be described convincingly. The request is examined by the Ministry and, if necessary, is submitted to the national council which takes the accordant decision.

12. Tax-stamp: 125 stamps for the request and 2.50 for each sheet.

13. If the request is granted, the employer must make a deposit according to article 128 and submit a certificate of the Social Security Agency of Costa Rica which confirms that the applicant is registered as an employer.

14. The employer must inform the Ministry immediately, if a worker with special employment is not actively employed by him any more.

15. If the employer wants to employ the worker with a special employment permit at another place than the original or likes to replace him with another worker, this must be communicated to the foreigner authority or the relevant department of the Ministry.

16. The employer can reclaim the deposit, if the legal residence permit of the worker has expired and the worker has left the country.
