FOREIGNERS SERVING A SENTENCE
legal basis: Article 137, guideline CIRCULAR -SDG-461-2007, from 12 March 2007

According to article 68 of the law the Ministry of Justice, an appropriate Minister or another person must request the temporary residence permit for foreign persons, who were condemned by a Costa Rican court in the following cases:

a. If the person can be dismissed completely or partly from the penal institution.

b. If the responsible judge suspended the punishment on probation or a medical case affected the situation positively.

c. If the Institute of Criminology approves a privilege concerning the according-to-law execution of the term of imprisonment.

The request is to be addressed directly to the Ministry and should contain the following documents:

1. Request to the general manager, signed by the Minister of Justice or from a deputy, containing the following
information:

a. Background of the request, in which the request is justified.

b. Explanation whether the person can work or not according to the criteria of the Ministry of Labor and Social Security.

c. Data of the foreigner:

" Complete name
" Nationality
" Occupation
" Date of birth
" Complete names and nationality of parents
" Prospective place of residence in Costa Rica
" Kind, validity period and number of the passport
" Prospective duration of the stay in Costa Rica
" Place within the legal district of San José or an electronic medium determined by the Ministry, which is specified in the Official Journal, in order to receive notifications.
2. Authenticated copy of the passport. If this is not possible, it must be requested by a representative of the consulate with the Ministry of Justice; if this representative does not exist, the Ministry of Justice can agree with the State Department, so that the formalities can be accelerated in order to receive the document from the country of origin of the foreigner.

3. Proof of fingerprints of the Ministry for Public Security

4. Current passport photo

5. Requesting the temporary residence permit does not mean the acceptance at the same time.
